Terms of Service Samzwam

Article 1. General
These terms and conditions apply to every offer from Samzwam and to every agreement established between Samzwam and the consumer. By placing an order, you agree to these terms.

Article 2. Offer and Agreement
- All offers are non-binding and subject to availability.
- The agreement is established at the moment you place an order and receive a confirmation by email.
- Images of products (especially mushrooms and growing results) are indicative. Because we work with natural products, actual shapes or colors may vary.
Article 3. Prices and Payment
- The listed prices are in Euros, including VAT and excluding shipping costs.
- Payment must generally be made in advance via the offered payment methods (such as iDEAL, PayPal, Credit Card).
- For existing customers, payment afterwards (on invoice) is only possible after explicit consultation and approval by Samzwam.
- Retention of Title: All products delivered by Samzwam remain the property of Samzwam until you have paid the full amount (including any shipping costs).
Article 4. Delivery
- We strive to ship orders as quickly as possible. Stated delivery times are indicative and are not strict deadlines.
- The risk of damage or loss of products transfers to the consumer at the moment of delivery.
Article 5. Growing Results & Warranty
- Natural Product: Growing mushrooms is a natural process. The final result (the harvest yield) strongly depends on factors beyond our control, such as temperature, humidity, hygiene, and care by the customer.
- No Harvest Guarantee: Samzwam guarantees that we deliver vital and high-quality spawn/materials, but we cannot guarantee a specific harvest yield. Failed harvests due to environmental factors are not grounds for a refund.
- Help & Advice: If a cultivation attempt fails, we are happy to help. Send us photos and a description of your approach, and we will advise on improvements or look for a lenient solution if it appears the material was at fault.
Article 6. Returns & Right of Withdrawal
- For non-perishable products (hardware, tools), the statutory cooling-off period of 14 days applies.
- For fresh products (spawn, plugs, kits), the right of withdrawal does not apply because these can spoil.
- Specific rules regarding returns, costs, and deadlines are described in detail in our Refund Policy elsewhere on this website.
Article 7. Complaints & Duty to Report Damage
- Check your order immediately upon receipt.
- Fresh products: Is there visible damage, leakage, or contamination upon arrival? Report this within 48 hours of receipt via retour@samzwam.nl (preferably with photos).
- Other complaints can be reported via our customer service. We aim to respond within a few days and find a solution together.
Article 8. Liability
- Samzwam is not liable for damage caused by incorrect use of the products (e.g., failing to follow growing instructions).
- Samzwam's liability is limited to a maximum of the invoice amount of the relevant order. We are not liable for indirect damage or consequential damage.
Article 9. Privacy
We handle your personal data with care. How we do this is described in our Privacy Policy.
Article 10. Applicable Law
All legal relationships are exclusively governed by Dutch law. Disputes are preferably resolved mutually. If we cannot reach an agreement, the court in the Netherlands has jurisdiction.
